SUBDIVISION COMMITTEE

July 9, 2002

Minutes

 

The Subdivision Committee of the Andover Planning Commission was called to order by Chairman Lynn Heath at 5:31 p.m. on July 9, 2002.  The other member present was Ron Roberts. Also present were Zoning Administrator, Les Mangus, City Clerk/Administrator, Jeff Bridges, and Administrative Secretary Deborah Carroll.

 

Jeff Bridges, Lynn Heath, and Ron Roberts expressed their condolences to Tim McFadden regarding the death of his father.

Call to order.

 

 

Motion to approve the minutes of the May 14, 2002 Subdivision Committee meeting as presented was made by Ron Roberts.  Lynn Heath seconded the motion.  Motion carried 2-0.

 

Motion to approve the minutes of the May 14, 2002

 

 

Review the preliminary plat for Sunflower Estates Subdivision located on East U.S. Hwy. 54 (McFadden property). Kenny Hill from Poe and Associates presented information on behalf of the owners of the Sunflower Estates Subdivision. Mr. Hill presented a revised plan that addressed the majority of the staff comments. Tim McFadden was present. 

 

Les Mangus informed the Committee members that a full function signalized intersection at Yorktown is planned with funds from KDOT Corridor Management.

 

Les Mangus asked for lot count. Mr. Hill stated there are 174 in this plat. Bob Kaplan of Kaplan, McMillan and Harris stated that James McFadden commitments from the Zoning hearing are stated in the minutes of the last Planning Commission meeting and that they will be upheld.

 

Tim McFadden stated the size of the lots should be between 7,200 square feet and 8,400 square feet. Mr. McFadden said his father had not received the footprints of the homes at the time of the last Planning Commission meeting. Mr. McFadden said he knew larger homes would need larger lots.

 

Kenny Hill stated there are more lots and larger lots than on the original plan.

 

Mr. Hill continued by addressing the Staff comments dated June 25, 2002 as follows:

1.      Ron Roberts stated he has concerns with the location of Yorktown right of way to preserve the hedgerow. The street can be placed off center to preserve the trees.                         

2.      Janet Court., Darlene Court., and Bridget Lane exceed the 500 feet maximum cul-de-sac. Regulations say "generally" and the revised plan generally meets that length.                  

3.      Existing structures would remain as legal non-conforming use.

4.      Sunflower Drive is a loop street and should have just street name.                                                                                

5.      Sunflower Drive conflicts with an existing street name in the Willowbrook Addition.                                                      

6.      Provide preliminary layouts for utilities and storm water facilities. Mr. Hill stated these are not done yet but will be for the next Planning Commission meeting.                                

7.      Provide a vicinity map. Kenny Hill stated that this is included on the revised plan.                                                          

8.      Provide a statement on utilities and streets. Kenny Hill stated that this is included on the revised plan.                         

9.      Provide a preliminary drainage plan. Kenny Hill provided this with the revised plan.                                         

10.  Preliminary platted lots do not meet the 7,200 square foot minimum quoted during zoning. Kenny Hill said this is adjusted on the revised plan.                                              

11.  Lots along the east property line do not meet the 100 feet minimum depth for MH-2. Kenny Hill said this is adjusted on the revised plan.                                  

12.  Indicate that Lots 3 and 4 Block 3 have legal non-conforming residential structures from prior annexation. Kenny Hill provided this with the revised plan.

13.  Provide cross-lot access to all commercial lots. Kenny Hill provided this with the revised plan.                           

14.  Indicate Anna Drive at U.S. Hwy. 54 will be right-in and right-out only. Kenny Hill provided this with the revised plan.

15.  Notes: 4. screening wall 5. USPS approval required (wall could be built in the reserve, but not sure)

 

Les Mangus stated that according to the regulations, no screening is required.

 

Tim McFadden said that if a wall is built, there should be a minimum requirement.

 

Bob Kaplan stated that a majority of the residents on the east side did not want a wall constructed. It is only needed between the B-3 and MH-2 properties.

 

Lynn Heath expressed his concern for the minimum lot size.

 

Ron Roberts is concerned with the simple point of access to the subdivision, and that he will not support 160 families using a single entrance to U.S. 54.

 

Tim McFadden stated there is a right-in right-out access planned on Carolyn Drive and temporary full function access that has been approved by KDOT until Yorktown is opened.

 

Ron Roberts said he would like to see access from the residential area to Minneha and one on Yorktown.

 

Bob Kaplan said that Gene Viterelli, one of the owners of Cloud City residential, just wants to preserve the hedgerow.

 

Kenny Hill said the estimated cost of constructing Yorktown street adjacent to this property will be one half million dollars.

 

Tim McFadden said he thinks a collector street (Yorktown) is not needed.

 

Ron Roberts asked about the ability to limit phasing of the project based on points of access. Les Mangus said that could be done. Mr. Roberts said that some communities limit to 50 lots per access.

 

There was general discussion about collector streets.

 

Les Mangus said that 8-foot sidewalks are required only on collector streets by policy. He also stated that Cloud Avenue is a collector street for the commercial district.

 

There was general discussion about the agreement previously made with James McFadden about the type of homes to be built in the subdivision.

 

Tim McFadden was concerned that if he builds the development in phases of 50 homes, and if the Genesis Company goes out of business, could there be a notation on the plat that the homes in the subdivision must be UBC approved and doublewide in size?

 

Kenny Hill stated the proposed homes will be UBC approved with a 1,267 square foot minimum. There was general discussion about plat notes. Lynn Heath said he wanted it written on the plat that the garage must be attached.

 

Mr. Heath further commented that he foresees opposition to the lack of sidewalks and 7,200 square foot lots.

 

Ron Roberts said he would like to send this issue to the Planning Commission with no recommendations due to too many questions. There was general discussion about lot size and sidewalks in the plan.

 

Les Mangus asked Kenny Hill to provide a minimum lot size and average lot size by next weeks Planning Commission meeting.

 

Motion by Ron Roberts to send the Sunflower Estates Preliminary Plat to the Planning Commission with no recommendations due to the following concerns:

1.      Possible lot size and density in the area.

2.      Lack of sidewalks on some streets

3.      Outlet to Yorktown at 4 cul-de-sacs and at least 1 to align with Minneha

4.      Temporary extension of Anna Drive to Kellogg

Motion was seconded by Lynn Heath

Motion carried 2-0.

Review the preliminary plat for Sunflower Estates Subdivision

 

 

Review the final plat for the Summerfield Addition located on the north east corner of Heorman Street and Lafayette Street. The owners are Scott and Jan Bishop represented by   Russ Ewy of Baughman Company, P.A. explained the plat and also stated that they will be asking for a variance for 5 feet on Lafayette Street and 5 feet on the railroad side. He stated the existing right of way Lafayette Street is 60 feet and the regulations state it is to be a minimum of 64 feet.

 

There was general discussion about the existing neighborhood, building setbacks, street right of way widths, and street improvements.

 

Discussion on the staff comments on the preliminary plat checklist and about making the vicinity map more detailed.

 

Ron Roberts asked whether when the street is vacated, shouldn't each owner get one half of the right of way.

 

Mr. Mangus stated a case history on the dedication and vacation of the Heorman Street right of way. He further said that these two adjacent owners agree on the ownership of the vacated right of way in this case.

 

Les Mangus stated that Butler County owns the rail road adjacent to this property.

 

Motion by Ron Roberts to recommend approval of the final plat for Summerfield Addition along with the satisfaction comments from Mr. Mangus to the Planning Commission. Motion was seconded by Lynn Heath. Motion carried 2-0.
