August 13, 2002

Minutes

 

The Subdivision Committee of the Andover Planning Commission was called to order by Chairman Lynn Heath at 5:35 p.m. on August 13, 2002.  The other members present were Dave Martine, and David Ledgerwood. Also present were Zoning Administrator, Les Mangus, and Administrative Secretary Deborah Carroll. Members absent were City Clerk/Administrator, Jeff Bridges, and Ron Roberts.

Call to order.

 

 

Motion to approve the minutes of the July 9, 2002 Subdivision Committee meeting as presented was made by Lynn Heath. No one else was in attendance from the July 9 meeting for a second of that motion. Motion carried.

Review the Final Plat of the Green Valley Commercial Subdivision located East of Onewood Drive on U.S. Hwy. 54. Landowner Jay Russell and Kenny Hill of Poe and Associates presented information to the Committee concerning the Green Valley Greens Commercial Final Plat.

 

Kenny Hill began by explaining that this plat is part of the Green Valley PUD. He said this property is zoned as B-5. Mr. Hill stated that there is a reverse road frontage street. Lynn Heath asked Les Mangus if they are going to need room for the access road besides having the reverse access road. Les Mangus said that it would not be needed at this time. He said that's why there is the 150-foot building setback for when KDOT makes up their mind about the highway. Jay Russell said that when he purchased the property he was under the assumption that they would build along the north side of Tee Time Street. They have had to give up 2-3 acres of ground they could have sold for properties to go on and feel like they are being penalized for bringing the project back to the south side of Tee Time. Required improvements may become a point of discussion by the time this case reaches City Council. Kenny Hill reminded the Committee that there is according to the PUD requirements, a 150-foot reserve on the East Side running the length of the subdivision, which could be used.

 

Les Mangus stated that someday there will be a reverse frontage road built that will extend all the way back to the east into the other tracts.  Dave Martine asked how the commercial property would be accessed. Mr. Russell said that there will be a driveways off of Onewood Drive and Prairie Dunes. Mr. Mangus showed the Committee his suggestions for other drives entering the property from Prairie Dunes, Onewood Drive , and Tee Time.

 

There was general discussion about the placement of driveways to the properties.  Mr. Mangus suggested that Kenny Hill order a traffic study report to be done.

 

Lynn Heath said the front of the shopping center will face Kellogg, but there will be no access to the property along Hwy. 54. Les Mangus stated that because the owner does not know how large each of the commercial tracts will need to be, the owner would be required to re-plat or split. At that time the Committee would ask for the joint access agreement on each lot line so they can cross circulate.  Lynn Heath asked for clarification that the only way to access the building be from the back. Mr. Mangus stated that it could be accessed from the back or from the Prairie Dunes Street side.  David Ledgerwood arrived at the meeting at 5:45.

 

Les Mangus stated that the zoning is already in place for this property and that all that needs to be done at this meeting is to approve the plat. Dave Martine asked if Tee Time Street would access the apartments when they are built. Kenny Hill stated that the reserve on the plat was documented in the text stating- Reserve A will be used for screening, landscaping, utilities, and drive approaches.

 

Les Mangus said that Onewood Drive would need access control on it. Mr. Mangus also wants to see a traffic report on it first to tell the Committee the needs for a dedicated left turn lane restriction based on the trip generation by the shopping center and the apartments. Kellogg and Onewood will be a 4-way signalized intersection. There was general discussion about future plans for this area.

 

Kenny Hill stated that according to the Staff Comments, he still needs to provide access control for Prairie Dunes except 1 entrance each side of the street 75 feet south of the South right of way of TeeTime Street. This can be done following the traffic study.

 

Dave Martine asked when Prairie Dunes Road comes out onto the highway will if it go east and west. Les Mangus answered that it will only be right in and right out only.

 

Jay Russell wants a cost estimate submitted before the traffic study is ordered. Les Mangus stated they may have to dedicate some of the Green Valley 8th Addition entry reserve property as right of way. 

 

Lynn Heath made a motion to recommend this case to the Planning Commission the Green Valley Greens Commercial Addition with the outstanding requirement of the traffic study concerning access off of Prairie Dunes, Onewood and TeeTime. Motion seconded by David Ledgerwood. Motion Carried 3-0.

Review the Final Plat of the Crescent Lakes Addition Third Phase. Bob Whittaker, landowner, and Kenny Hill from Poe and Associates presented the Final Plat of the Crescent Lakes Addition Third Phase.  Kenny Hill stated that this is an approve Planned Unit Development from 1996. He said this is 24.22 acres, 56 lots in which the average lot size is 11,844 square feet and that the minimum lot size is 9,000 square feet. There is only to be 1 access road on to Central. 

 

Lynn Heath questioned Kenny Hill as to sidewalks in this area. Mr. Hill stated this is pointed out on the PUD text for Lakecrest and Woodstone streets which states that sidewalks shall be provided on one side of each collector street or as shown if an alternate sidewalk plan is approved by the City of Andover which provides for some sidewalks to be located in the proposed open space Reserves in place of the collector street sidewalk location which is Item 7 in the General Provisions on the Plat. There was general discussion about the sidewalk location and width.

 

Dave Martine asked if there are any changes in the Reserves. Kenny Hill said that yes there is. One change is that the Reserve has been run up the back of the lots which was a walkway access easement and the owner wanted to change that to a Reserve for a nature trail. Mr. Whittaker said they have always wanted to preserve the trees in the area. Dave Martine clarified that there is a Reserve along Central, which would simulate the Reserve that is already there that goes west. Bob Whittaker stated there is an additional Reserve coming down the middle of the property that he has not made final plans for yet. Kenny Hill stated that Reserve B is noted for drainage. Les Mangus stated that he had no changed suggested for Kenny Hill on this Plat, and that he has met all the requirements for opening up the next Phase. There was general discussion about the campground area, picnic area, pool and playground. Bob Whittaker said there is no restriction on privacy fencing in the area except for around the lake and in that area they are only allowed to use wrought iron so the lake is accessible to all homeowners.  Lot 19 is reported by Mr. Whittaker to be a playground. He said that there are only 8 lots left in Phase II out of 29 that were opened a year ago. 13 lots are open in Phase I.

 

Motion by Lynn Heath to recommend the Crescent Lakes Addition Final PUD Plan Third Phase to the Planning Commission for approval with no changes. Second by Dave Martine. Motion carried 3-0.

Review the Preliminary Plat for the Hoover Tracts located at SW 120th Street and the County Line. Roger Cutsinger, Registered Land Surveyor with Goedecke Engineers represented the property owner in this case. He explained that the Committee had received copies of the Preliminary Plat map and that this is the southeast corner of southwest 120th and County Line. Mr. Cutsinger said there would be controlled access along the county line road and along the north side. Mr. Cutsinger stated there is water from RWD #8 already ran there and that the owner is planning on using septic systems on the lots. Les Mangus stated this is a county plat. Mr. Cutsinger stated that these are 21-acre lots. The existing easements are now drawn on the map. Les Mangus stated that the traffic would only be able to access this property from Blazing Meadows Road. He said we have Subdivision jurisdiction and our Planning Commission would have to approve this plat.  It then would go to the County Commission for their acceptance of the dedications Mr. Mangus stated this is extra territorial subdivision jurisdiction and that the Township will be taking care of the roads.  There was general discussion about the maintenance of the township roads in this area.

 

Mr. Cutsinger stated that there is an existing oil pipeline 50 foot total easement. Les Mangus said the Andover regulations are for 50-foot building setback from the center of the oil pipeline.  Lynn Heath stated that the streets are already there, water service is on site, and the property owners have the option of either using septic systems or lagoons.

 

Les Mangus asked if the county had approved this plan. Mr. Cutsinger said they had. There was general discussion about the county planning regulations and that this property is zoned as Rural Residential, which requires a minimum lot size of 10. Mr. Mangus said that Mr. Cutsinger has addressed all the staff comments.

 

Lynn Heath made a motion to recommend the Preliminary Plat for the Hoover Tracts located at SW 120th Street and the County Line to the Planning Commission with the 7 comments from Staff plus the 50 foot setback from the oil pipe line on Lot 1. David Ledgerwood seconded motion. Motion carried 3-0.

Review the Final Plat for the Hoover Tracts located at SW 120th Mr. Cutsinger said he knew he would have to add the 50-foot setback to this plat and that the basic drainage plan map has been received by the City. Les Mangus stated the City has received title policy for this property. Dave Martine asked Mr. Cutsinger why there is no restrictive covenant required on this case. Mr. Cutsinger answered that it is the owner's choice.
