Minutes

 

The Andover City Subdivision Committee met for a regular meeting on Tuesday, August 10, 2004 at 909 N. Andover Road in the Andover Civic Center.  Acting Chairman Clark Nelson called the meeting to order at 5:30 p.m. The other members present were Charlotte Bass and Ron Roberts. Others in attendance were Administrative Secretary Deborah Carroll, and City Clerk/Administrator Jeff Bridges.  Commission Member Jan Cox and Zoning Administrator Les Mangus were absent.

Review the minutes of June 8, 2004 meeting.

 

Ron Roberts made a motion to approve the minutes as presented. Clark Nelson seconded the motion. Motion carried 2/0/1 with Charlotte Bass abstaining.

Communications:

Review the City Council minutes from the July 13, 2004 and July 27, 2004 meetings. The minutes were received and filed.

 

Review the minutes of the July 6, 2004 Site Plan Review Committee Meeting. The minutes were received and filed.

 

Review the minutes of the July 20, 2004 Planning Commission meeting. The minutes were received and filed.

 

Review the Potential Residential Development Lot Report.

Election of officers.  Clark Nelson stated this agenda item will be deferred until next month when the full board is present.

LS-2004-02: Review the proposed lot split of Lot 22 of Mecca Acres Revised Plat No. 2- 1105 W. US-54 and

LS-2004-03: Review the proposed lot split of Lot 21 of Mecca Acres Revised Plat No. 2- 1023 W. US-54: Charlotte and Peter Bauer, property owners & Cindy Ball, representing the Wellners presented the lot splits. Cindy said this lot split is a requirement from the city. The current lots have been split by deed. Cindy said this has been very time consuming to get this issue resolved.

 

Clark Nelson read a memo from Les Mangus concerning this case. “These applications arise from a division of 2 lots along US-54 in the Mecca Acres Subdivision, which have existing buildings with frontage on US-54 & vacant land on Clyde Street. The former owner divided and sold the north half of the Lots 21 & 22 by deed to the Bauer’s, who in turn sold the north half of Lot 22 to the Wellner’s.  The division of the 2 platted lots into 4 new parcels constitutes a subdivision, and requires approval of a lot split or replatting. The lot split documents meet Staff approval as to form, but no cooperation has been achieved in the required dedications to meet the minimum street right of way and utility easements. Staff recommends approval of the lots splits contingent on the satisfaction of the Checklist comments including the required dedications.”

 

Cindy Ball said the previous owners; Ruben & Dorothy Ornelas need to sign the Street Right-of-Way Dedication to complete this process.

 

Jeff Bridges asked for clarification of ownership of the properties in question. The Bauer’s said they own lots 21B, 22B, and the Ornelas’ own lot 21A.

 

Charlotte Bauer submitted a copy of the right of way from 1982 as signed by the Ornelas’. She said Les is requiring a Street Right-of-Way Dedication along Clyde and Ruth Streets.

 

Clark Nelson suggested the applicants sign all requested documents before the next Planning Commission meeting to show everything within their power has been accomplished.

 

Cindy Ball said there are several documents to be signed and filed with the Register of Deeds for this transaction to be complete.

 

Clark Nelson recommended this application be approved subject to the staff comments and that the dedications be approved by the City Council before the lot split may be approved. He apologized to the applicants for the red tape.

 

Cindy Ball said she will not have this property redrawn until the lot split is approved because she has already had the expense for it 3 times. Her understanding is the City is prepared to take action in this case if the previous owner does not sign the dedication.

 

Ron Roberts asked if this property is zoned commercial. Charlotte Bauer said the north half is.

 

Ron Roberts made a motion to recommend approval to the Planning Commission for the Lot Splits as presented subject to Staff Comments. Charlotte Bass seconded the motion. Motion carried 3/0.

LS-2004-02 & LS-2004-03: Review the proposed lot split of Lots 21 & 22 of Mecca Acres Revised Plat No. 2- 1105 & 1023 W. US-54:

 

 

Review the Final PUD Plan for the Winchester Addition the Second Phase of the Tuscany PUD. Kenny Hill of Poe and Associates and representing owner Len Marotte presented the plan. He said the developer wants to cut the phase back to 39 lots from the original 59 lots on the plan. The drainage plan Kenny submitted showed the entire PUD. He said this phase would be for the part on the west. Minor changes have been made to some of the lot widths to accommodate triple car garages.

 

Ron Roberts asked about sidewalks in the PUD. Kenny stated there are 8’ sidewalks running north and south along Vintage Drive and a 5’ sidewalk running east and west along Tuscany Drive. All the requirements will stay the same according to the original PUD. Kenny said an extra wide right-of-way was platted (70’ vs. 66’ requirement) to accommodate the 8’ sidewalk. Kenny said the developer wants to build nicer homes in this addition and they chose to scale the project back due to the financial burden for the letters of credit.

 

There was general discussion about the comments from Les. Kenny said the only item remaining is to deliver the title report. The drainage plan has been submitted.

 

Clark Nelson asked Kenny to explain how to read a drainage plan. Kenny also submitted a lot grading plan that specifies the elevations of each lot corner and each building site within the addition.

 

Clark asked how to determine compliance to these plans. Kenny said they grade the area from the front property line to the rear and there are as built surveys once the home is built according to plan. Kenny said sometimes there are problems with builders and utility companies not putting the grade back to compliance. They even set benchmarks on the curbing at various locations on the as-builts so the owners can use those and don’t have to go very far for a benchmark to build the next home according to grade.

 

Jeff Bridges asked how the vacation of the earlier Second Addition Plat would be handled. Kenny said that has not been done yet, but he knows this will be a requirement of platting.

 

Clark Nelson said that from Les’ comments, this plan meets staff approval contingent upon the checklist items.

 

Ron Roberts made a motion to recommend approval to the Planning Commission for the PUD as presented and subject to staff comments. Charlotte Bass seconded the motion. Motion carried 3/0.

Review the sketch plat for the River Subdivision, a replat of portions of the Allen Bales Tracts and Carl Mitchell Addition located at US-54 and Daisy Street. Kenny Hill described this plan and said it is located on the southwest corner of Kellogg and Andover Road and that the property is platted and zoned. It extends over to Allen Street, south to Pointer Drive. Daisy Street extends north to south through the middle of the property from Pointer Street to Kellogg and Pointer will extend from Daisy to Allen and Allen Street is platted also.

 

The right-of-way on Daisy and Allen Streets at the widest point are 52’. The proposed plan is for Pointer Street to curve east to west and, would not have any parking on the street. Daisy Lane would be the same running north and south and would be a 60’ wide right-of-way with 30’ of paved street. A median would be built at the intersection of Hwy. 54 which will direct traffic through the right-in right-out which is part of the highway project that has been put out for bids. There have been additional right-of-ways granted on Allen Street to make that transition at an angle.

 

Kenny said Allen Street could provide parking and is platted as a 64’ street right of way with a 35’ width. Daisy Street as proposed would dead end in a hammerhead turnaround. It can tie to the rear access of Lot 1 Block 3 if the plan is developed as shown on this plan. Jeff said Feather Street could carry traffic west to Allen Street.

 

Kenny said he is working with Les about the 50’ right-of-way along Kellogg from Daisy east to the Carl Mitchell Addition and is right next to the highway. This does not work well with the plan of the right-in right-out of the median. They are proposing moving that access another 100-150’ south as shown on this plan. Kenny said a semi with a 50’ wheel base can get in and out of this area. They want to use the existing pavement for parking and then move the driveway to the south. The entry point would probably be 40’ instead of 30’ as shown on the plan.

 

Owner Hal McCoy said there is a cross ingress/egress agreement already in place.

 

Mr. McCoy said he has owned this property for 4-5 years and explained his vision for this project/property called “The River” and building the country/family atmosphere for the City of Andover. He went into great detail about the Walnut Valley Country Store and other buildings planned for the area which includes a hotel and event center. The east side of the property is planned to be commercial.  Each building will be required to contain some sort of water feature to work in with the theme of the “River”.  There is a verbal agreement with the existing liquor store that they will change their building to conform to any architectural theme that this development has. This development is planned to have continuity not cookie-cutter looks.

 

Clark Nelson said this plan supports the intent of the updated Comprehensive Development Plan.

 

Kenny Hill said sewer is available on site.  He said there is one small area that may need to be relocated. The owner wishes to fast track this project. They will be preparing the final plat for this property very soon.

 

Clark Nelson said in his memo he is in favor of this plan moving forward.

 

Jeff Bridges asked if Mr. McCoy would maintain ownership of the pad sites. Hal said no, he would not, but there will be a covenant agreement which will require existing uses or changing uses or change their architecture, and would include a common area maintenance agreement.  Hal will propose a more advanced common area maintenance agreement where not only do we maintain the snow removal and trash removal, but also landscaping, and lots sold to designate a certain % on their sales to fund a common marketing and promotion agreement.

 

Charlotte Bass asked if the drainage plan has been submitted. Kenny Hill assured her it has been submitted for approval and he is sure everything will work fine.

 

Ron Roberts made a motion to approve the sketch plat of the River Subdivision as presented subject to the comments by Staff. Charlotte Bass seconded the motion. Motion carried 3/0.
