Review the Sketch Plan for the Serendipity Estates
Preliminary Planned Unit Development located at 200 N. 159th
street. Property owner Robert
Kaplan was present to answer questions of the committee.
Les stated the owner desires to divide a ten acre
tract with an existing home into 5 lots with a private access drive. The arrangement
of lots along the long driveway exceeds the 500 foot maximum length for a
cul-de-sac which has triggered the need for a PUD.
Les said this is a sketch plan which will go to the
Planning Commission as a Preliminary PUD at the October 18 meeting.
Jeff Bridges asked if a road would be built to
access parcel 5. Bob Kaplan said he would extend the existing road. Jeff
Bridges asked if it would be paved. There was no response.
Bob said he is marketing Parcels 4 and 5 together
and thinks they will sell to 1 owner who will not need an access road to
Parcel 5. The existing pond would be divided between the owners of Parcels 3
and 4.
Les said Reserve A should be noted as an access
parcel which would be a private road. Clark Nelson asked how wide the road
needs to be to comply with Fire codes. Les said Chief Shaver needs to be
consulted for this. Les said the right-of-way seems to be adequate and
marginal access allows 50’ in width. He is more concerned with improvements
to the road and private ownership of the road.
Ron Roberts said a
homeowners association needed to be formed to decide maintenance issues of
this road.
Ron Roberts was concerned
about approval of a gravel road within the city limits of Andover. Bob Kaplan
said the road is the beauty of the property with the gravel road giving a
“country feel”. He said he does not want a paved road on this property.
Les was concerned about the maintenance of the lake.
He said common ownership of a lake is asking for problems. Clark Nelson said
a common maintenance agreement needs to be provided. Bob Kaplan said this
pond is only ¾ acre and will not be a problem. He further stated the dam was
built in 1972 and is solid as the day it was built with an overflow pipe. He
said this dam has never needed any maintenance other than mowing.
Clark Nelson asked if the owner of Parcel 1 would
have access to the pond. Bob Kaplan said no. Only the private owners of
Parcels 3 and 4 would have access to the pond. There was further discussion
about a lake maintenance agreement. Bob Kaplan said that could be included in
the homeowners association. He also said a covenant could be created between
the lake owners which would be a recorded document and would be passed on to
the new owners of the property when it is sold.
Les said the city would require a clause in the homeowner’s
association maintenance agreement that states failure to maintain the road
would initiate the city to take care of it and assess the costs back to the
abutting property owners. There was further discussion about the future
paving of this road should the majority of the property owners desire it
done.
Ron Roberts was concerned
about the length of the cul-de-sac. There was general discussion about
cul-de-sacs. Clark said there are only 5 lots in this PUD so the length of
the cul-de-sac is not an issue.
Les asked about splitting this project into Phases 1
& 2 because the extension of water and sewer service would be more
manageable. Bob Kaplan said the house on Parcel 4 is serviced by well water and
has a lagoon. Bob said all of these properties will be put onto city
utilities.
There was general discussion about the extension of
utilities. Les said there is no easement around the public sanitary sewer.
Bob Kaplan said there is an easement under the berm north and south. Bob said
he would try to obtain an easement along Lakeside at no cost to the city.
There was general discussion about potable water
from domestic wells and wells used for irrigation.
Bob Kaplan said he would prefer this plat be
approved as submitted with the extension of the roadway, properly labeling it
as “Reserve A” access, creation of a homeowners association, and maintenance
provisions for the pond and road. Les is concerned about the details in the
covenant between the property owners. Bob said the maintenance of the lake
should be in a document solely between the 2 property owners.
Clark Nelson said the issue of gravel vs. paving of
the road will be decided at the Planning Commission meeting. Ron Roberts is concerned about fast moving traffic creating dust if the road is not paved. Bob
Kaplan said an asphalt mat would not be a problem.
Les was concerned about the drainage along the road
because there are no defined ditches to carry water during a heavy storm. 4
individual driveway connections to the road will change the drainage flow.
Bob said the water would drain to the bar ditch, and the rest would drain to
the pond. Les said half of Lot 2 drains to the pond and the other half goes
to 159th Street. Les is concerned about the future homes being
designed with a walk-out basement and berms. He insisted on a formal drainage
plan with set pad elevations.
Les asked if a building setback line or build to
line would be designated adjacent to the reserve. Bob Kaplan said that could
be provided. Bob said there is a 6’ fall from the north to the south property
lines. Les said the fall of the grade prohibits building either walk-out or
view-out homes.
This case can be heard by the Planning Commission on
October 18, 2005. Bob Kaplan said he will get a revised drawing for Les.
